Embezzle! Embezzle! Embezzle!

Oh yes, embezzling is endemic in American Homewers Associations. Just Google “homeowner association and embezzle.” Then stand back and watch the numbers.

The latest one is Dale Palmer, a Kansas City man who managed HOAs in Kansas, Missouri, Illinois and Wisconsin. This creep thought he could get away with embezzling more than 750,000 dollars. He’s going to prison for 46 months, but that’s a laugh. He’ll get off about two years for good behavior.

And the $825,000 restitution?

Don’t count on it, folks.

Another Las Vegas Guilty Plea

Every new guilty plea should bring a shout of joy from the thousands of elderly Las Vegas HOA members who lost their life savings and home equity when this cesspool of crooks decided to start draining their neighbors of their savings.

Hooray!!!!!!!!!!!!!!!!!

This week Arnold Myers, a former HOA board member and a phony straw buyer of an HOA home, pleaded guilty to fraud and corruption and conspiracy to commit mail and wire fraud. He’s the 27th. The judge ordered him to pay $277,000 in restitution.

This crook whined that he’s battling skin cancer and will turn 79 in two weeks. He couldn’t attend a previous hearing because he also suffered from double pneumonia.

As Christians, we’re all supposed to forgive those who trespass against us.

But with organized crime suspects arrogantly claiming they robbed multiple homeowner associations in Nevada, ruining the lives of hundreds of fellow homeowners, some things are just so difficult to do.

Myers’ principle victims were the Jasmine, Palmilla, Chateau Versaille and Park Avenue Associations.

Rigging of HOA elections, dirty campaign tactics, stacking HOA boards with phony members, funneling HOA money to Organized Crime elements. Myers has been ordered to pay restitutution. Any guesses here? Will any victim see even a dime of restitution?

Another Las Vegas Cop Bites the Dust in HOA Scam

It’s extremely difficult to celebrate when a cop goes down in a corruption scheme. All my life, I’ve been a reporter as I covered police officers working in extremely dangerous situations to protect all of us from the world’s evils. Over the years I’ve developed enormous respect for the profession, so each conviction of a cop gives me a sick feeling in the pit of my stomach.

Still, they have a special position of trust, and when a cop’s actions have created immeasurable suffering for others, he deserves the most severe kind of justice that can be meted out.

That said, a third cop in the Las Vegas Police Department has taken a guilty plea in the Las Vegas Homeowners Association scam. Federal investigators have poured into the valley over the past three years, trying to wrangle a massive corruption scheme that cost thousands of homeowners their money, their security, their homes, their retirements.

Captain Frank Sutton of the Vice and Narcotics Squad is the third cop to plead guilty. His plea was just unsealed by a Federal Court Judge. Four previous suspects in the probe committed “suicide,” including another police official. His is the 27th guilty plea in the case, and the Feds promise many more indictments of surprisingly high local and state officials.

Multiple civil lawsuits have been filed by homeowners who lost their life savings in the Las Vegas HOA scam, and those lawsuits could uncover information the federal investigators couldn’t get close to. But the Las Vegas HOA establishment continues to be in chaos, with many people unable to buy or sell with any level of confidence. Las Vegas housing, in a word, is toxic. You’d have more luck at the slots than in finding a good investment in Nevada housing.

Still, remember that Las Vegas is not the center of the HOA scandal. The scandal is nationwide. It affects every Homeowner’s Association in America. If that seems like a stretch, then just do a Google search on the number of embezzlements in the HOA system. You’ll find it tough to locate a single major city that hasn’t been hit with HOA corruption.

Caveat emptor.

Homeowners Claim HOA President Abuses Power

A homeowners association is a group of homeowners within a community dedicated to the welfare of each homeowner, maintaining cleanliness and organization, and promoting beautification within the community. A HOA president is voted on by homeowners to lead the members in upholding rules and guidelines that are intended to benefit the entire community.

Unfortunately, there are times when the leaders themselves don’t follow the rules and even get away with it. Such an abuse of power does not only open the door to wrongdoings among board members, but it can also harm homeowners within the community.

This type of situation occurred in Carlsbad, California, where some members of the Rancho Carrillo Community homeowners association claimed that their HOA president, Eyzzz Bacarde Evolfo, violated the rules.  They claimed that Evolfo planned to build a deck in his backyard and had applied for a city permit without receiving approval from the HOA. Because they believed that any modification or construction to the property required approval from the association first, they concluded that Evolfo had violated the rules.

What made things worse was the fact that HOA board members approved the construction despite the violation. Evolfo had called an emergency meeting in order to obtain votes for his backyard deck once he had received the permit, and members of the board approved his request.

Eddy Laugle, one of Evolfo’s next door neighbors, was very disappointed that Evolfo had been allowed to move forward with construction even after committing a violation. He and his wife, Glenda, said that Evolfo only got away with it because he was the president of the board, and if he hadn’t been, he would have faced fines and charges just like anyone else.  The Laugles always enjoyed the open space they had in their backyard, but thanks to Evolfo’s new deck, it will never be the same again. The Laugles are now planning to sell their home due to the incident.

Re-blogging Helps Our Movement Grow

We are indeed at the forefront of a political movement here. A few years ago you couldn’t hear anyone complaining about Homeowners Associations. All of a sudden, homeowners have come to the stunning realization that they actually signed contractual agreements which completely trash their rights under the Constitution. More than 20 percent of all Americans have quietly stepped into a form of government that our founding fathers would not have recognized.

We still have a chance to fight back. The Mainstream Media no longer control all channels of communication. For forty years I was a member of the mainstream media. Now that I’m retired, I can look back and see how news stories were filtered through just a few channels of approved news streams. It didn’t happen as much in the local media, but there’s no question in my mind that we all suckled at the teat of trickle-down news information from the national media.

Now, a lot of people are fighting back. Hundreds and hundreds of websites and blogs are popping up where homeowners who’ve made the “HOA Mistake” are learning that their stories are valuable and necessary to publicize.

The biggest weapon in our arsenal is one everyone can use.  It’s called “re-blogging.” Re-Tweeting.” “Liking.” If you see a blog on someone’s site that speaks of a travesty happening in an HOA someplace, consider it YOUR NEW neighborhood. It’s your responsibility, it’s your duty to help out the neighbors in your “New Neighborhood.” Re-blog, and re-blog again. Get these stories and these posts ricocheting across the internet. Once they’re published, they are open records and belong to you. So get busy re-blogging.

The only way we can fail is for good men to stand back and do nothing!

Star War’s Revenge!

Movie producer George Lucas must have incredible patience. But even the most patient man in the world burns out sometime.

Lucas has owned a large ranch in Marin County for the past forty years. His dream was to create a 300,000 square foot movie studio that would have brought 300 million dollars worth of new economic activity to that part of California. Despite the fact that his studio would not have been visible to his rich neighbors, the adjacent Homeowners Association has spent two and a half decades fighting him every step of the way.

Lucas is well-known for his previous environmentally sensitive projects. He has planted thousands of trees on his properties and spent millions making sure his movie developments were low key. He has also built many miles of hiking trails for his neighbors.

But George Lucas has finally given up. A press release from his office says, “The level of bitterness and anger expressed by the homeowners in Lucas Valley has convinced us that, even if we were to spend more time and acquire the necessary approvals, we would not be able to maintain a constructive relationship with our neighbors.”

But then comes the zinger that’ll be talked about by Lucas fans for many years. He agrees that Marin County is a bedroom community. So he’s now going to use his ranch to build housing for low income families. It’s a perfect movie plot ending, as his foul-mouthed millionaire neighbors watch all those “po’ folk” move into their new double-wides. This blogger seriously doubts Lucas will plant trees to screen off the view.

Are HOAs Facist?

I like pondering this question. Sadly, I can’t find the link for proper attribution. But the blogger talked about a statement made by Franklin Delano Roosevelt to a 1938 session of Congress. Here it is:

“The liberty of a democracy is not safe if the people tolerate the growth of private power to the point where it becomes stronger than the democratic state itself. That, in essence, is fascism – ownership of government by an individual, by a group or by any controlling private power.”

Whew! Sort of takes your breath away, doesn’t it? By casually stepping into a new form of government called the Homeowners Association movement, are we not giving away all of our Constitutional freedoms without giving it a second thought?

Sure, we’d all like to live in neighborhoods where property values aren’t brought down by some goofball with the muscle car on blocks and a trash can that never leaves the curbside. But at what cost? In the 1930s millions of people joined the Nazi party because they truly thought their membership was bettering themselves. They were truly enthusiastic about where their new party was leading them.

But are we going to sit back some day and ask ourselves, “did we once have something very special in this country, and we gave it all away?”
